									<p>As per the World Intellectual Property Organisation (WIPO), a trademark is “a sign that is capable of distinguishing the goods or services of one enterprise from those of other enterprises.” Whereas, if we look at India, the Trademarks Act of 1999 defines a trademark as “a mark that is capable of being represented graphically and also is capable of distinguishing the goods or services of one person from those of others. It may also include the shape of goods, their packaging and the combination of colours.”</p><p>Do not let the term ‘represented graphically’ mislead you, though. Even a sound or a motion<a href="#_ftn4" name="_ftnref4"></a>, can become a ‘mark’ under trademark. The weight remains on if it helps differentiate a product or service from its competitors. Therefore, one can say that trademarks form a part of one’s distinctive brand or trade identity. The more popularity a brand or a trademark gains, the more important it becomes to protect it. One can argue that a trademark sometimes even plays an important role in the goodwill of a business.<a href="#_ftnref1" name="_ftn1"></a></p>								</div>

									<p>Trademarks play an important role apart from the main role of ‘differentiation’. They indicate a certain quality and standard of the said goods or services being offered. This is the role that most closely associates with goodwill. When a tech enthusiast sees the apple with one-bite in on the Apple logo, he associates it with a certain quality and standard that is associated with the goodwill of Apple Inc.</p><p>Next, we must understand what is the purpose of most Intellectual Property Rights. The ‘rights’ that are referred to in IPR are primarily exclusionary in nature. This means that the rights granted in intellectual property are mainly for the purpose of excluding other persons (individuals or companies, or any legal person) from using the IP holder’s property for commercial purposes. Now with that out of the way, one simple reason for trademark protection is to prevent unfair use of one’s brand identity. It does so by not only providing rights, but also giving remedies to the right holders in case those rights are violated. Therefore, trademark protection also deters unfair competition between corporations and companies.</p><p>Trademarks also aid in preventing consumer confusion. They serve as a mark of identification. Here, it becomes important to point out that sometimes a trademark might be in the form of a ‘trade dress’. A trade dress is a form of packaging or presentation of goods or services that a reasonable consumer would associate with a certain business, brand or company. A consumer might purchase a Coca-Cola bottle without the label, as they associate the shape of it with the identity of the Coca-Cola brand.</p>								</div>

									<p>Trademarks are also measured in respect of their ‘strength’. It is the measure of the distinctiveness of that particular mark. A trademark may be arbitrary, fanciful, suggestive or descriptive. This also determines if the mark can get protection under the <a href="https://jotwani.com/services/best-lpo-firm-in-india/">law</a> or not. The strongest marks are ones that are arbitrary, fanciful and out of the ordinary.</p><p>Nike uses a swoosh symbol, which is really unique. This is a strong trademark. Additionally, made-up words also constitute strong and distinct marks. The name ‘Labubu’, for example, or the term ‘Kodak’, are made-up terms which do not have a usage in ordinary day-to-day life. Therefore, granting protection to them becomes easier.</p><p>If one uses a reference that is out of the ordinary, the resultant trademark can expand protection jurisdiction in one’s industry. In the case of Bhavanesh Mohanlal Amin And Anr vs Nirma Chemicals Works And the court restrained a party from using the name ‘NIMA’ for a separate class of goods from ‘NIRMA’, which is a well-known washing product brand (protection under trademark law is largely granted specific to a class of goods or services and is not a blanket protection). The word ‘NIRMA’ is an invented word and holds a strong reputation. Therefore, its use was not permitted by another person even though the goods they sold were in a different class. This shows how an arbitrary or abstract mark can grant greater protection to the mark holder, as it becomes more difficult to associate its meaning with anything else.</p><p>Similarly, an arbitrary or fanciful mark does not describe or suggest any characteristic of the product. The word ‘Yamaha’ has nothing to do with motorcycles, nor does the word ‘Apple’ have anything to do with computers. This is why such marks are called ‘fanciful’ and have the strongest protection as they are new and have no prior use with respect to the goods or services they are now being associated with.</p><p>Suggestive marks do not describe the product but suggest its nature or characteristics. For example, ‘Boost’ as an energy drink does not describe the drink, but implies strength. It also implies that the drink supplements the strength of consumers.</p><p>Descriptive marks are the weakest marks to get protection for. They might identify the product in one way or another. It is general in nature. Think of a pizza shop that trades with the brand of ‘Best Pizza’. To get protection under trademark law, a descriptive mark must show that it has acquired a secondary meaning in the minds of consumers. An example of this is businesses that operate with surnames or family names. They are deemed as descriptive marks. A mark of this kind will not get protection until it acquires a secondary meaning. Examples of this include ‘McDonald&#8217;s’, ‘Bajaj’, ‘Mahindra &amp; Mahindra’ or ‘Hilton’.</p><p>Last come generic marks. These marks do not get protection in law. This is because they will cause unfair competition in an industry or class of goods if they are granted protection. For example, if a dairy company could register the word ‘Milk’ as a mark as they sell that product, it would disallow other dairy companies from using the term ‘Milk’, which is generic in nature and cause the competitors to not be able to describe their products at all. Such generic words are deemed to have become <em>publici juris</em> (belonging to the public) and therefore cannot be appropriated by anyone.</p>								</div>

									<p><a href="https://ialm.academy/courses/online-certification-course-filing-obtaining-trademarks" target="_blank" rel="noopener">Trademarks</a> can be of varying kinds. These include word marks, sound marks, device marks, colour marks, collective marks, shape marks, certification marks, or even shape and smell marks.</p><ul><li>Word Marks protect words, which usually include brand names or business names. If one wishes to protect the name of their business or brand, they shall apply under this category to protect it as a word mark. This protection extends not only to the word itself, but all forms of that word, whether it be written plainly or represented artistically in a logo or a different font.</li><li>Sound Marks are marks that are represented in a sound. These can be registered in India, given that they are less than 30 seconds in duration. One would need to submit the sound in the form of an MP3 (previously, it was submitted in the form of sheet music). The Yahoo! Yodel was the first sound mark to be registered in India. Now, sounds such as the Nokia device switching on tone, the ICICI jingle, and the National Stock Exchange theme song are all registered sound marks in India.</li><li>Device Marks are pictures, photos, drawings, special layouts or special fonts. These include mascots as well. Therefore, characters, mascots, or even non-textual logos can be granted protection under this category. The Amul girl, the Maharaja from Air India, the Nike Swoosh or the bitten-into apple from Apple are all examples of device marks.</li><li>Smell marks are the rarest forms of marks that can be granted protection. This is because they can only be registered if the smell of a product does not arise from the natural character of the product. This means that one cannot protect the smell of coffee arising from their coffee beans. The trademark office manual classifies them as ‘unconventional marks (alongside colour marks, sound marks and shape marks), and they require more than representation as just chemical formulas, written description, or odour samples. These cannot be registered in India currently, as they do not have a ‘graphical representation’. However, instances elsewhere have occurred where Olfactory marks have been granted protection under law. The prerequisite here is that the mark has a unique distinctiveness to it.</li><li>Colour Marks are, as the name suggests, colours which are granted protection under trademark law, a they are associated with a certain brand in a certain class of goods. The most well-known example of this is Cadbury chocolate’s purple packaging, which has the status of a colour mark (after a long drawn legal battle) in the UK. In India, the famous French designer, Christian Louboutin, managed to secure their shoes’ red soles as a protected trademark.</li><li>Shape Marks are marks that help one distinguish a product from another by the shape it carries. The caveat to register a shape mark is that it must not originate from the natural state of the goods being sold, be necessary to obtain a certain technical result, or give substantive value to the goods. Therefore, it must be an aesthetic add-on associated with the identity of the brand selling the goods. A good example would be the previously discussed Coca-Cola bottle.</li><li>Certification Marks are marks that indicate a certain quality of a product or service. The ISI logo is one of the best examples of this. These marks are conventional and usual.</li></ul><p><a href="#_ftnref1" name="_ftn1"></a></p>								</div>

									<p>Lately, courts have held that domain names can also serve as a trademark. This is because they possess all the needed features of a trademark and help individuals identify a business. If a person uses a similar or the same domain name as the trademark or name of another business, it may lead consumers to believe that they are engaging with someone else. Therefore, an action of passing off can lie in such cases. In 2000, in the case of Acqua Minerals Ltd. v Pramod Borse<a href="#_ftn1" name="_ftnref1"><strong>[1]</strong></a>, The Delhi High Court had restricted the respondent from using the domain name ‘bisleri.com’ as it was deemed to be a trademark of Acqua Minerals, the company that owned Bisleri, the water bottle brand.</p><p>Another recent development has been that of hashtags. The US Trademark Office has recognised that hashtags may hold the status of a trademark if they serve as identifiers (this is also the necessary precondition for a hashtag to qualify as a trademark).<a href="#_ftn2" name="_ftnref2">[2]</a> In Singapore as well, hashtags have attained a similar status. For example,“#PizzaMeNow”has been registered by Pizza Hut International with the Trademark Register.</p><p>Lastly, an interesting aspect to keep a note of is the rise of Artificial Intelligence. AI has been coming into a prominent space of use by multiple businesses and enterprises. The problem here is that a lot of prominent AIs and LLMs are trained on similar datasets and information. This may lead to replicated, similar and duplicate end products, which may enhance the need for due diligence on the part of businesses. Additionally, without proper protocols or legislation in place to protect data or to allow individuals and corporations to opt out, some IP may inadvertently end up in the pool of public knowledge at the hands of the said AI and LLM models.<a href="#_ftnref1" name="_ftn1"></a></p>								</div>

									<p>In the current article, I am going to write about the biggest offence of the lawmakers. Lawmakers have been positioned to maintain the law and order of the country and protect the citizens of the country from different mishappenings or injustices. They also help people to change their perspectives amongst each other. They are creating offences in the country that are the biggest shame for our country&#8217;s image. Many case laws talk about this issue, which I will discuss in this article.</p><p> </p><p>The Supreme Court’s landmark judgment on <strong>March 4, 2024</strong>, declared that lawmakers cannot claim immunity under <strong>Articles 105(2) and 194(2) of the Constitution</strong> for acts of bribery. Overturning the controversial <strong>1998 P.V. Narasimha Rao ruling, the Court ruled that immunity protects legislators’ speech and votes strictly within parliamentary duties and does not extend to criminal acts like bribery. Chief Justice D.Y. It has exposed inefficiencies, irregularities, and corruption in various government sectors, making bureaucrats and public officials more cautious about their actions and decisions.<br /><br /></p><p>For instance, RTI applications have played a key role in uncovering corruption scandals, such as the 2G spectrum allocation case and the Commonwealth Games scam, which involved mismanagement of public resources on a massive scale. Citizens have used RTI to scrutinize public welfare schemes, uncovering discrepancies in their implementation and allocation of resources.<br /><br /></p><p><b>2. Empowerment of Citizens</b><br />RTI has significantly empowered ordinary citizens, enabling them to become active participants in democracy. It has given the marginalized and underprivileged a tool to demand accountability from public authorities. Farmers, labourers, and rural citizens have often used RTI to gain access to information about land records, employment schemes, and other government services, ensuring their rightful entitlements.</p><p><br />For example, in rural India, citizens have successfully used RTI to check the distribution of rations, and wages under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA), and the allocation of resources under other welfare schemes. By doing so, it has allowed people to exercise their rights more effectively.</p><p><br /><b>3. A Tool Against Corruption</b><br />RTI has emerged as a potent weapon against corruption. Activists, journalists, and common citizens have used it to uncover corrupt practices at various levels of government. This has helped in holding public officials accountable for their actions. Through RTI, many have exposed cases of embezzlement, irregularities in public procurement, and misuse of office.</p><p><br />A striking example is the way RTI has been used to expose the mismanagement of funds allocated for welfare programs such as the Mid-Day Meal Scheme. The transparency brought by RTI has forced government officials to be more careful about public expenditure, as citizens now have the means to question the legitimacy of decisions.</p><p><br /><b>4. Judicial and Legal Reforms</b><br />The RTI Act has also led to significant judicial and legal reforms by bringing transparency to the functioning of the judiciary. Though the judiciary initially resisted the application of RTI to its own affairs, the Act has been gradually applied to administrative functions of the courts. Landmark judgments have expanded the scope of RTI, making it applicable to various government bodies, including political parties and law enforcement agencies, albeit with some restrictions.</p><p><br /><b>5. Many public authorities do not have adequate resources or staff to process the requests efficiently.</p><p><br />This delay is further exacerbated at the level of Information Commissions, which are often overburdened with appeals and complaints. In some states, cases have piled up for years, undermining the effectiveness of the Act.</p><p><br /><b>2. Lack of Awareness and Education</b><br />While RTI is a powerful tool, its reach has been limited by a lack of awareness, especially among rural populations. Many people in remote areas still do not know how to file an RTI application or are unaware of their right to access government-held information. The lack of comprehensive education campaigns has meant that large sections of society remain excluded from exercising this right.</p><p><br />This gap is particularly stark in tribal areas, where issues like land rights and access to public welfare schemes are critical but under-represented due to low levels of literacy and awareness about RTI.</p><p><br /><b>3. Threats and Intimidation Against RTI Activists</b><br />A worrying challenge is the increasing number of threats and attacks on RTI activists. In the last decade, numerous whistleblowers who used RTI to expose corruption have faced intimidation, harassment, and even violence. Some have lost their lives. The lack of a strong whistleblower protection mechanism has deterred many citizens from using RTI to expose irregularities in governance.</p><p><br />This situation has created an atmosphere of fear and insecurity, with activists calling for stronger legal safeguards to protect those who file RTI requests in the public interest.</p><p><br /><b>4. Dilution of the RTI Act</b><br />In recent years, there have been concerns about attempts to dilute the power of the RTI Act. Amendments made in 2019 altered the terms of appointment and salaries of Information Commissioners, which many activists see as an attempt to undermine their independence. Critics argue that these changes may compromise the impartiality of the Information Commissions, reducing their ability to hold public officials accountable.</p><p><br />The reduction in proactive disclosures by many government departments, coupled with these amendments, has raised alarms about the possible erosion of the transparency regime created by RTI.</p><p><br /><b>5. Exemptions and Misuse</b><br />Several public authorities have been exempted from the purview of RTI, particularly security and intelligence agencies. Though these exemptions are made in the name of national security, critics argue that they have often been misused to avoid scrutiny. Furthermore, there have been instances where RTI has been misused for personal vendettas, leading to frivolous requests that burden the system unnecessarily.</p>								</div>

Maintaining fake financial statements</strong><br />Inaccurate financial documents like balance sheets and account books can give the impression of a low annual income. Some businesses also do not keep sale receipts to understate their income and reduce their tax due for the year.</p><p><strong>4. Using fake documents for tax deductions</strong><br />Another tax evasion tactic is getting fake documents made to prove that you are eligible for a tax deduction, such as a disability certificate to claim tax deductions under Section 80.<br /><strong>5. Not showing any income</strong><br />Many people resort to cash transactions to hide the trail of their earnings. Not having any income on paper implies that you do not have to pay any tax either. Businesses often do not produce invoices for their sales. Similarly, landlords may accept only cash payments instead of bank transfers or cheques for rent.</p><p><strong>6. Keeping money outside India</strong><br />International bank accounts are not under the purview of the Indian income tax department. Some people may maintain a bank account outside the country to store money.</p><p><strong>7. Not paying tax</strong><br />A lot of people may refuse to pay taxes. Then, despite the tax dues, the person does not make the necessary payments to the government.</p><p><strong>8. Offering a bribe to an official</strong><br />Offering a bribe to an income tax official to change the amount of tax due is another way to evade tax. 									<p>The penalty for tax evasion can depend on the fraud committed and the extent of the unpaid tax. Here are some situations and the subsequent penalties levied in case of each:</p><p><strong>1.Failing to file your income tax return within the due time</strong><br />As per subsection (1) of Section 139 of the Income Tax Act of 1961, all taxpayers must file their income tax return during the tax filing period for each financial year. If anybody does not file their income tax return for any reason, they have to pay a late fee. This late penalty fee was ₹10,000 till the financial year 2019-20. However, effective from 2020-21, anybody filing a belated income tax return is charged ₹5,000 as a penalty. In some cases, the assessing officer can also decide the value of the penalty, which can be less or more than ₹5,000.</p><p><strong>2. Proving incorrect PAN card number or hiding the pan card number</strong><br />Failure to furnish accurate information while filing ITR is also a punishable offence. Most employers ask for the employees’ PAN card numbers at the time of employment. This information is used while deducting TDS or the tax deducted at source from the employee’s salary. Here’s the penalty for two scenarios involving a PAN card:</p><p>Hiding the pan card number: In the absence of a PAN card number, the employer will deduct 20% TDS instead of 10% TDS.Providing an incorrect pan card number: In case of an incorrect PAN card number, you will have to pay a penalty of ₹10,000.</p><p><strong>3. Concealing or misreporting your Income</strong><br />As per Section 271(C) of the Income Tax Act of 1961, in case of hiding or understating your income, the penalty can be anywhere between 100% to 300% of the amount of tax that was due but not paid. Here’s how the percentage is decided:</p><p><br />A penalty of 10% on the previous year’s hidden or understated income is levied if the taxpayer owns up to the undisclosed income and declares it. Interest may also be charged here.</p><p><br />A penalty of 50% on the amount of income that is hidden or understated, is levied if the reason behind the under-reporting was a bona fide mistake. This refers to a genuine mistake that is not committed with an aim to evade tax.</p><p><br />A penalty of 300% on the amount of hidden or understated income is levied if the mistake was intentionally made to evade tax. This is also known as a mala fide mistake.</p><p><br />Income tax officials may feel compelled to raid a location to find the taxpayer’s undeclared income. Consequently, the penalty will be computed according to Section 271AAB in such instances.</p><p> </p><p><b>4. Not complying with TDS regulations</b></p><p>For businesses or employers who deduct and collect tax at source, having a tax deduction account number (TAN) is vital. Not having a TAN can result in a penalty of ₹10,000. There are two kinds of frauds that can be committed here:<br /><br />Not collecting tax at source: In this case, the penalty is the same as the tax that was not deducted at the source.<br /><br />Not filing a TDS return: Just like income tax returns, there is also a due date for filing TDS returns. If the TDS return is not filed within the stipulated time, the taxpayer has to pay tax every day after the due tax until the entire payment is made. The penalty, in this case, can start from ₹10,000 and go up to ₹1, 00,000.<br />To avoid paying this penalty, taxpayers must file TDS returns before the prescribed due date.<br /><br /></p><p><b>5. Failure to comply with a demand notice</b><br />The income tax (IT) department may issue a demand notice if inconsistencies are found in the income tax return. If this happens, the IT department issues a demand notice stating the amount of tax still owed. The taxpayer is offered 30 days to respond to the demand notice from the day of receiving the document. A failure to respond and pay the tax due can result in a penalty.<br /><br /></p><p><b>6. Not paying tax as per self-assessment</b><br />Taxpayers who fail to pay entire or a part of their self-assessed tax or interest are considered defaulting taxpayers. Failure to pay tax as per self-assessment is considered to be tax fraud under Section 140A (1). In such a case, the assessing officer can levy a penalty up to the total amount of tax owed to the government. However, if there is a valid reason for not paying tax as per self-assessment, the assessing officer may waive off the penalty.<br /><br /></p><p><b>7. Not getting audited</b><br />If an organization does not get itself audited or does not submit an audit report under Section 44AB, they have to pay a penalty of ₹1.5 lakhs or 0.5% of their sales turnover, whichever is more. In addition to this, if the taxpayer does not provide a report from an accountant as mandated under Section 92E, they have to pay a penalty of at least ₹1 lakh or more. To avoid the penalty, the taxpayer must document all domestic and overseas transactions and obtain a report from a chartered accountant in India on or before the deadline. In addition, a penalty of 2% of the value of the transaction (international or domestic) will be applied if any documents required by the Act are not given or attached under Section 92(D)3.</p>								</div>

Recently, India has entered into a pact with the US to avoid tax evasion by Americans through Indian financial organizations. Special Bearer Bond Scheme (Immunities and Exemptions Act, 1981) enable persons in possession of black money to invest in special bonds. The comprehensive changes introduced by the Patent Rules 2024 aim to make the patent procedure in India, more efficient, streamlined, and accessible for applicants. The present article discusses and analyses some of the important amendments.

									<p>A significant modification in the Indian Patent Rules, 2024 is the reduction in the time limit for filing a request for an examination (RFE) for the patent application. The time limit has been reduced from 48 to 31 months, starting from the filing date or the priority date, whichever is earlier. By shortening the timeframe, the Indian Patent Office (IPO) aims to expedite the examination of patent applications, particularly those already examined by other <a href="https://www.google.com/maps?cid=11158607043462807277" target="_blank" rel="noopener">patent offices</a> under the Patent Cooperation Treaty (PCT). Under the previous Indian <a href="https://jotwani.com/amendments-in-indian-patent-rules-2024/">Patent Rules</a>, even after an international application entered India as a national phase (which typically occurs within 31 months from the earliest priority date in India), the applicant had additional time to decide whether to proceed with an RFE. However, the amendment in 2024 to the Patent Rules reduces the time frame from 48 months to 31 months as per Rule 24B(1). Accordingly, the RFE must now be filed at the national phase entry of the International Patent application. It is to be noted that the 31-month timeline for filing the RFE would only apply to applications filed on or after March 15, 2024. For applications filed before March 15, 2024, the 48-month timeline will continue to apply.</p>								</div>

									Another significant amendment in Indian Patents Rules in 2024 is the simplification in submitting a statement and undertaking regarding patent applications filed for similar or substantially similar inventions in the country outside India to the Controller of Patents, Indian Patent Office (IPO). Before 2024, the applicant was mandated to periodically update the IPO about any foreign patent applications in Form 3. This included filing detailed information within six months of any new filings or status changes, which created a considerable administrative burden and increased the risk of penalties for non-compliance. However, the amendment in 2024 to the Patent Rules allows the applicant to submit Form 3 (Rule 12(3)) within three months of receiving the first examination report. This revision alleviates administrative burdens and reduces the risk of penalties for non-compliance, thus providing a more streamlined and efficient process for patent applicants.								</div>

									<p>Additionally, working statements (in revised Form 27) for <a href="https://jotwani.com/best-ipr-law-firms-in-delhi/">patents</a> are now required only once every three years instead of annually, thus simplifying the reporting process. Before 2024, a patentee was required to file a working statement for granted patents every financial year, starting from the financial year commencing immediately after the one in which the patent was granted. However, after the amendment in 2024 in the Patent Rules, this requirement has been relaxed to once every three financial years, significantly reducing the administrative burden on the patent holders. The revised Form-27 no longer requires applicants to provide an approximate value accrued in India from &#8220;working&#8221; the patented invention. Instead, a patent holder must provide a clear explanation for why the invention does not work in India. There is also a provision in Form 27 that indicates whether a patent is available for licensing, offering the possibility of technology transfer and collaboration.</p>								</div>

Before 2024, there was no formal recognition of inventors in the patent documentation. In 2024, the Patent Rules were amended to allow inventors applying for certificates of Inventorship for granted <a href="https://ialm.academy/courses/PATENT-AGENT-EXAMINATION-2021-2022-62594c310cf2b8a80bc945c6" target="_blank" rel="noopener">patents</a> in India to submit Form 8A to the IPO.</p>								</div>

Earlier, there was no provision for filing divisional applications based on the information disclosed in the provisional or the complete specifications.								</div>

With the amendment of the Patent Rules in 2024, the Patentee is entitled to a ten percent discount on the renewal fee (Rule 80(3)) when the renewal fee is paid in advance for four years and through electronic means.								</div>

For instance, Applicants face a significant risk of their patent applications being abandoned due to unintentional delays. The amendments in Patent Rules, 2024 do not sufficiently address this issue, leaving applicants vulnerable to losing their rights without any fault on their part. Therefore, to enhance flexibility and protect applicants&#8217; interests, it is recommended that Patent Rules be established that allow for extensions where delays are unintentional, particularly concerning the national phase entry. It is believed that by addressing these concerns, the Indian patent system would enhance flexibility and would support innovation and creation in a better way.								</div>
